RAILROAD COMMISSION OF TEXAS NOTICE OF PUBLIC HEARING Application by The Sabine Mining Company for Renewal/Revision of Surface Coal Mining and Reclamation Permit 33H, South Hallsville No. 1 Mine Surface Mining Docket No. C16-0023-SC-33-C The Railroad Commission of Texas through a Commission Administrative Law Judge will conduct a public hearing beginning at 9:00 AM on Wednesday, December 5, 2018 in the City of Marshall City Hall, Room 201 (2nd Floor Conference Room), 401 S. Alamo Blvd., Marshall, Texas. The hearing concerns the application by The Sabine Mining Company (SMC) for renewal and revision of its surface mining and reclamation permit for the South Hallsville No. 1 Mine located in Harrison County, Texas. The hearing may be continued to various times and places by announcement at the hearing. All matters relevant to the application may be considered. The Sabine Mining Company, 6501 FM 968 W, Hallsville, Texas 75650, has applied to the Railroad Commission of Texas for approval of a five-year renewal to Permit No. 33H for its South Hallsville No. 1 Mine located in Harrison County, Texas. The permit area consists of approximately 44,401 acres and is southeast of Longview, south of Hallsville, Marshall, and Interstate 20, west of Highway 59, and north of the Sabine River. The proposed five-year renewal term is denoted as 2016-2020. SMC proposes to mine approximately 719.9 acres and to disturb 791.9 acres during the requested permit term within the Q, R, and S areas in the existing permit boundaries, under a revised life-of-mine plan. The application includes a reclamation plan. This hearing is held pursuant to the Texas Surface Coal Mining and Reclamation Act, TEX. NAT. RES. CODE CH. 134, Rule §12.211 of the “Coal Mining Regulations,” 16 TEX. ADMIN. CODE Ch. 12, Railroad Commission Practice and Procedure Rules, 16 TEX. ADMIN. CODE Ch. 1, and the Administrative Procedure Act, TEX. GOV’T CODE §§2001.051 et seq. The hearing may be canceled or continued prior to the scheduled date. If canceled, a written notice will be mailed to the parties and interested persons and a notice of cancellation will be published. Persons who desire to make unsworn public comment on the application may do so at the hearing. A person having an interest which is or may be adversely affected by the application and who wishes to become a party to the proceeding for the presentation of evidence and testimony may file a request for party status. Parties to the proceeding include the applicant, the Commission’s Surface Mining and Reclamation Division, and one landowner disputing, among other issues, right-of-entry and the reclamation plan. Parties may have counsel present. The application is on file for review by the public at the Harrison County Clerk’s office. The contents of the application may be revised during the course of the proceeding.
