CITATION BY PUBLICATION THE STATE OF TEXAS: CAUSE# 18-0495 SAM JACKSON AND SANDRA JACKSON IN THE 71ST DISTRICT COURT INDIVIDUALLY AND AS REPRESENTATIVES OF THE ESTATE OF SANTISHA JACKSON, DECEASED VS ROY’S TIRE SERVICE, ROY WOODS, OF INDIVIDUALLY AND D/B/A/ ROY’S TIRE SERVICE, TNM LOGISTICS, LLC AND HARRISON COUNTY, TEXAS LANARD MCMATH TO: TNM LOGISTICS, LLC GREETING: NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of 42 days after the date this citation was issued, a default judgment may be taken against you.” You are hereby commanded to appear by filing a written answer to the Plaintiff’s Original Petition at or before 10:00 o’clock A.M. on the Monday next after the expiration of 42 days after the date of issuance of this citation the same being Monday, DECEMBER 17, 2018, before the Honorable 71st District Court of Harrison County, at the Courthouse in said County in Marshall, Texas. Said Plaintiff’s Petition was filed in said court on the 26th day of APRIL, 2018 in the above entitled cause. A brief statement of the nature of this suit is as follows, to-wit: Prior to April 30, 2016, Defendants Roy’s Tire Service and Roy Woods, Individually and d/b/a Roy’s Tire Service, their agents and/or employees, operated a business in Jefferson, Texas, at which they offered goods and services, including, but not limited to, tires, wheels, and maintenance and installation of tires and wheels. Prior to April 30, 2016, Defendants, their agents and/or employees, regularly advertised and solicited business from the general public, including Plaintiffs. As a result of these advertisements and solicitations, Santisha Jackson (“Defendant”) and/or Plaintiffs Sam Jackson and Sandra Jackson brought a 2005 Ford Five Hundred (the “Five Hundred”) to Defendants’ Roy’s Tire Service and Roy Woods, Individually and d/b/a Roy’s Tire Service place of business in Jefferson, Texas and acquired goods and services that were offered, advertised, and solicited by Defendants Roy’s Tire Service ad Roy Woods, Individually and d/b/a Roy’s Tire Service. Defendants Roy’s Tire Service and Roy Woods, Individually and d/b/a Roy’s Tire Service, their agents and/or employees, then serviced the tires on the Five Hundred, and installed two new tires on the front of the Five Hundred. Defendants Roy’s Tire Service and Roy Woods, Individually and d/b/a Roy’s Tire Service, their agents and/or employees di so despite their prior knowledge that new tires must be installed on the rear of a vehicle when only two tires are being replaced. At approximately 8:35 a.m. on April 30, 2016, sometime after Defendants’ Roy’s Tire Service and Roy Woods, Individually and d/b/a Roy’s Tire Service wanton and negligent performance described above and herein, Decedent was driving the Five Hundred southbound on U.S. 59 in Harrison County, Texas. Suddenly and without warning, the Five Hundred left the roadway, where it was impacted by a 2006 Freightliner tractor-trailer driven by Defendant LaNard McMath in the course and scope of his employment with Defendant TNM Logistics, LLC. At the time of and prior to the collision, Defendant LaNard McMath failed to keep a proper lookout and failed to control the speed of his vehicle under the conditions presented. Decedent died as a result of her injuries sustained in the collision. Issued and given under my hand and seal of said Court at Marshall, Texas this 30th day of OCTOBER 2018.
