CITATION BY PUBLICATION THE STATE OF TEXAS TO: VIRGINIA E. WADLINGTON GOOD, LONCEAL DIXON, HARRY DIXON, HANNAH DIXON, SUSIE MAE DIXON, LEE JENKINS, ESTELLA JENKINS WALKER AND LEE JENKINS, JR., AND THEIR UNKNOWN HEIRS, DEVISEES, REPRESENTATIVES AND SUCCESSORS, IF SAID PERSONS ARE DECEASED: NOTICE TO DEFENDANTS: “You have been sued. You may employ an attorney. If you, or your attorney, do not file a written answer with the clerk who issued this citation by 10:00 a.m. on Monday next following the expiration of forty-two (42) days after the date of issuance of this citation and petition, a default judgment may be taken against you”. You and each of you are hereby commanded to appear and answer before the 71st Judicial District Court in the Harrison County Courthouse in Marshall, Texas, at or before 10:00 a.m. on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, being at or before 10:00 a.m. on Monday, the 5th day of September, 2022, then and there to answer the Application for Appointment of Receiver for Mineral Interests of COMSTOCK OIL & GAS, LLC in No. 22-0560, styled COMSTOCK OIL & GAS, LLC (Plaintiff) vs. VIRGINIA E. WADLINGTON GOOD, LONCEAL DIXON, HARRY DIXON, HANNAH DIXON, SUSIE MAE DIXON, LEE JENKINS, ESTELLA JENKINS WALKER AND LEE JENKINS, JR., AND THEIR UNKNOWN HEIRS, DEVISEES, REPRESENTATIVES AND SUCCESSORS, IF SAID PERSONS ARE DECEASED (Defendants). The Application for Appointment of Receiver for Mineral Interests, filed on the 21st day of July, 2022 in the 71st Judicial District Court, discloses that the nature of said suit is as follows: This suit is brought to have a Receiver appointed under the provisions of §64.091 of the Texas Civil Practice and Remedies Code for undivided mineral interests owned by the Defendants as set forth in Application for Appointment of Receiver for Mineral Interests, in the following described tracts of land (the “Land”) located in Plaintiff’s Hamilton Gas Unit, said unit being out of the James Cellum Survey, A-145, and James Adams Survey, A-34, Worley Linville Survey, A-398, and Aaron Poe Survey, A-19, Harrison County, Texas, to wit: Tract No. 3: 94.435 acres of land, more or less, situated in the James Cellum Survey, A-145, Harrison County, and being the same land described in the Warranty Deed with Vendor’s Lien dated August 29, 1972, recorded in Volume 714, page 148, Deed Records, Harrison County, Texas, from James Spencer Jones II and W.S. Allen to L. B. Thompson, limited to the Haynesville Formation, being the stratigraphic equivalent interval between 9,815 feet MD and 10,986 feet MD as identified on the Density/Neutron Log of the Platform Express dated March 25, 2008 for the Devon Energy Product Company, LP Fields-Isaacs #15 Well (API #42-203-34225). Tract No. 4: 67.202 acres of land, more or less, situated in the James Cellum Survey, A-145, Harrison County, and being the same land described as “Tract 1” of Section 2 in the Partition Deed dated June 27, 1969, recorded in Volume 672, page 211, from W.S. Allen and James Spencer Jones, II, to Gaines Baldwin, limited to the Haynesville Formation, being the stratigraphic equivalent interval between 9,815 feet MD and 10,986 feet MD as identified on the Density/Neutron Log of the Platform Express dated March 25, 2008 for the Devon Energy Product Company, LP Fields-Isaacs #15 Well (API #42-203-34225). Tract Nos. 6 & 6A: 44 acres of land, more or less, also called 44.082 acres, being 50.63 acres of land, more or less, situated in the James Cellum Survey, A-145, Harrison County, and being the same land described in the Deed dated November 7, 1912, recorded in Volume 72, page 537, from J.R. Tutle to Jim Dixon and Tom Dixon, LESS AND EXCEPT a 1.00-acre tract of land, more or less, being the same land described in the Warranty Deed dated February 4, 1004, recorded in Volume 2786, page 97, from John H. Mitchell to Marcelle M. Allen and husband, Earnest Allen, Jr., and LESS AND EXCEPT a 2.77 acre tract of land more or less, being the same land described in the Right of Way Deed dated November 25, 1933, recorded in Volume 197, page 311, from Tom Dixon and Jim Dixon to the State of Texas, and LESS AND EXCEPT a 2.778 acre tract of land, more or less, being the same land described in the Warranty Deed dated November 5, 1973, recorded in Volume 740, page 571, from Jim Dixon and only daughter, Margaret Dixon, to John Henry Mitchell, and limited to the Haynesville Formation, being the stratigraphic equivalent interval between 9,815 feet MD and 10,986 feet MD as identified on the Density/Neutron Log of the Platform Express dated March 25, 2008 for the Devon Energy Product Company, LP Fields-Isaacs #15 Well (API #42-203-34225). Tract No. 10: 2.778 acres of land, more or less, situated in the James Cellum Survey, A-145, Harrison County, and being the same land described in the Warranty Deed dated November 11, 1973, recorded in Volume 740, page 571, Deed Records, Harrison County, Texas, from Jim Dixon and daughter, Margaret Dixon to John Henry Mitchell, and limited to the Haynesville formation, being the stratigraphic equivalent interval between 9,815 feet MD and 10,986 feet MD as identified on the Density/Neutron Log of the Platform Express dated March 25, 2008 for the Devon Energy Product Company, LP Fields-Isaacs #15 Well (API #42-203-34225). Tract No. 11: 1.00 acre of land, more or less, situated in the James Cellum Survey, A-145, and being part of the residue of the same land described in the Warranty Deed dated January 22, 1974, recorded in Volume 740, page 573, described as 50.63 acres conveyed from Clinton Dixon to John Henry Mitchell and further being described in the Warranty Deed dated February 4, 2004, recorded in Volume 2786, page 97, from John H. Mitchell to Marcelle M. Allen and husband, Earnest Allen, Jr., limited to all depths from the stratigraphic equivalent interval between 9,815 feet MD and 10,986 feet MD as identified on the Density/Neutron Log of the Platform Express dated March 25, 2008 for the Devon Energy Product Company, LP Fields-Isaacs #15 Well (API #42-203-34225). And for said Receiver to execute an Oil, Gas and Mineral Lease thereon to the Plaintiff covering all interest of said Defendants in and to the land described above, and take such other action deemed necessary under the provisions of said statute.
