CITATION BY PUBLICATION THE STATE OF TEXAS TO: NETTIE LONG TURNER, THEORY LONG DIXON, KATHERINE (CAMMIE) LONG PETERS WILLIAMS, PATRICK JOHNSON, MARY LONG, ESSIE LONG WYATT, PAUL S. LEE, LORAINE BENNETT, MARTHA FULLER, BOOKER T. BARNES, BYRON LEE, GENEVA D. WILLIAMS, DALTON AUSTIN, ROSE MCCAULEY PATE, CLAUDE MANNING JONES AND BRENDA AUSTIN WILEY, AND THEIR UNKNOWN HEIRS, DEVISEES, REPSRESENTATIVES AND SUCCESSORS, IF SAID PERSONS ARE DECEASED: NOTICE TO DEFENDANTS: “You have been sued. You may employ an attorney. If you, or your attorney, do not file a written answer with the clerk who issued this citation by 10:00 a.m. on Monday next following the expiration of forty-two (42) days after the date of issuance of this citation and petition, a default judgment may be taken against you.” You and each of you are hereby commanded to appear and answer before the 71st Judicial District Court in the Harrison County Courthouse in Marshall, Texas, at or before 10:00 a.m. on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, being at or before 10:00 a.m. on Monday, the 25th day of July, 2022, then and there to answer the Application for Appointment of Receiver for Mineral Interests of COMSTOCK OIL & GAS, LLC in No. 22-0444, styled “COMSTOCK OIL & GAS, LLC (Plaintiff) vs. NETTIE LONG TURNER, THEORY LONG DIXON, KATHERINE (CAMMIE) LONG PETERS WILLIAMS, PATRICK JOHNSON, MARY LONG, ESSIE LONG WYATT, PAUL S. LEE, LORAINE BENNETT, MARTHA FULLER, BOOKER T. BARNES, BYRON LEE, GENEVA D. WILLIAMS, DALTON AUSTIN, ROSE MCCAULEY PATE, CLAUDE MANNING JONES AND BRENDA AUSTIN WILEY, AND THEIR UNKNOWN HEIRS, DEVISEES, REPRESENTATIVES AND SUCCESSORS (Defendants). The Application for Appointment of Receiver for Mineral Interests, filed on the 6th day of June, 2022 in the 71st Judicial District Court, discloses that the nature of said suit is as follows: This suit is brought to have a Receiver appointed under the provisions of §64.091 of the Texas Civil Practice and Remedies Code for undivided mineral interests owned by the Defendants as set forth in Application for Appointment of Receiver for Mineral Interests, in the following described tracts of land located in Plaintiff’s Havron Gas Unit, out of the James Cellum Survey, A-145, and James Adams Survey, A-34, Harrison County, Texas (the “Land”), to wit: Tract No. 2: 22.75 acres, more or less, out of the James Adams Survey, A-34, Harrison County, Texas, described in that certain Warranty Deed dated January 3, 2001, from H.C. Havron to James Bradley Collier and wife, Vicki L. Collier, recorded in Vol. 2190, Page 238 of the Official Public Records of Harrison County, Texas, further described as being all of said 22.75 acres, more or less, lying within the bounds of the Havron Gas Unit, and being more particularly described as 22.75 acres being Tract No. 2 in the Unit Designation of the Havron Gas Unit No. 1, recorded in Vol. 3626, Page 293 of the Official Public Records of Harrison County, Texas. Tract No. 3: 5.00 acres, more or less, out of the James Adams Survey, A-34, Harrison County, Texas, described in that certain Warranty Deed dated August 12, 2005, from James Bradley Collier and wife, Vickie Collier to John W. Claassen and wife, Reness Claassen, recorded in Vol. 3161, Page 78 of the Official Public Records of Harrison County, Texas, further described as being all of said 5.00 acres, more or less, lying within the bounds of the Havron Gas Unit, and being more particularly described as 5.00 acres being Tract No. 3 in the Unit Designation of the Havron Gas Unit No. 1, recorded in Vol. 3626, Page 293 of the Official Public Records of Harrison County, Texas. Tract No. 7: 72.00 acres, more or less, out of the James Cellum Survey, A-145, and James Adams Survey, A-34, Harrison County, Texas, described in that certain Warranty Deed dated September 11, 1883 from D.P. Austin to Columbus B. Austin, recorded in Vol. 19, Page 67 of the Deed Records of Harrison County, Texas, further described as being all of said 72.00 acres, more or less, lying within the bounds of the Havron Gas Unit, and being more particularly described as 72.00 acres being Tract No. 7 in the Unit Designation of the Havron Gas Unit No. 1, recorded in Vol. 3626, Page 293 of the Official Public Records of Harrison County, Texas. And for said Receiver to execute an Oil, Gas and Mineral Lease thereon to the Plaintiff covering all interest of said Defendants in and to the land described above, and take such other action deemed necessary under the provisions of said statute.
