CITATION BY PUBLICATION STATE OF TEXAS TO: MARGUERITE ALEXANDER MAGGIOLANO aka MARGUERITE ALEXANDER VACQUERIN, Defendant - GREETINGS: You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two (42) days from the date of the issuance of this citation, a default judgment may be taken against you. You are hereby commanded to appear by filing a written answer to COMSTOCK RESOURCES, INC. AND COMSTOCK OIL & GAS, LLC’S FIRST AMENDED ANSWER AND PETITION IN INTERPLEADER AS COUNTERCLAIM AND CROSS-CLAIM at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being Monday, November 8th, 2021, before the Honorable Brad Morin, 71st Judicial District Court of Harrison County, Texas, at the court house of said County in Marshall, Texas. COMSTOCK RESOURCES, INC. AND COMSTOCK OIL & GAS, LLC, Counter-Plaintiffs, filed suit in said Court on the 31st day of August, 2021, against Marguerite Alexander Maggiolano aka Marguerite Alexander Vacquerin, Defendant, and said suit being numbered 21-0675 on the docket of said Court, and styled, RED STONE RESOURCES, LLC vs. JAMES WEEKS TILLER, JR., ROBERT CARROLL TILLER, ALBERT WAYNE TILLER, CHARLES ERIC TILLER, JR., COMSTOCK RESOURCES, INC. AND COMSTOCK OIL & GAS, LLC, JANIS HEATH, LORA BLACK, BILLY DENMAN, HARPER FAMILY LIMITED PARTNERSHIP, CCRC FAMILY LIMITED PARTNERSHIP, Defendants and COMSTOCK RESOURCES, INC. COMSTOCK OIL & GAS, LLC (Counter-Plaintiffs) vs. KALLISTE ENTERPRISES, LTD., NANCY LEE HUBER TIMMINS, TRUSTEE OF THE TIMMINS FAMILY TRUST, PETER ALBERT ALEXANDER, FRANCES A. PAPAILIOU, and MARGUERITE ALEXANDER MAGGIOLANO aka MARGUERITE ALEXANDER VACQUERIN, defendants. A brief statement of the nature of this suit is as follows, to wit: A dispute has arisen between competing claimants, each of whom believe they are entitled to the royalties in question. Under the provisions in the leases, Comstock is only required to pay the rightful owner of the mineral interest described in the leases. Due to the ambiguous nature of certain title documents, Comstock is faced with uncertainty in determining the rightful royalty owners, and is asking the court to render judgment by interpreting the language of the title document or documents in question. Marguerite Alexander Maggiolano aka Marguerite Alexander Vacquerin is a potential claimant to the royalties under the Subject Property. Counter-Plaintiff is seeking Appointment of an ad litem to protect the potential mineral interest of Defendant MARGUERITE ALEXANDER MAGGIOLANO aka MARGUERITE ALEXANDER VACQUERIN regarding this dispute of ownership of mineral interest in the following tract of land herein defined as the “Subject Property”. 343.60 acres, more or less, being a part of the John Findley Survey, A-247, Harrison County, Texas and A-1024, Panola County, Texas, being more particularly described by metes and bounds as follows, to wit: Beginning at the Southwest corner of said 343.60 acre tract of land at a stake for corner in the North margin of the Grand Bluff and Shreveport Road; Thence North 330 varas; Thence North 42° West 116 varas; Thence North 9° West 257 varas; Thence North 23° West 76 varas; Thence North 82° East 136 varas; Thence North 942 varas to stake for corner; Thence East 1148 varas to stake for corner; Thence South 1617 varas to stake for corner; Thence West 702 varas to stake for corner; Thence South 3° East 136 varas to stake in North margin of said Grand Bluff and Shreveport Road; Thence West 108 varas with North margin of said Grand Bluff and Shreveport Road to corner; Thence North 81 West 332 varas to place of beginning, containing 343.60 acres of land, more or less, and being the same land described in that certain Warranty Deed dated May 17, 1949 from J.R. Tutle to James W. Tiller, Sr., recorded in Volume 338, Page 243, Deed Records, Harrison County, Texas. Counter Plaintiff is represented by J. DON WESTBROOK, P.O. BOX 2665, LONGVIEW, TEXAS, 75606. If this Citation is not served within ninety days after the date of its issuance, it shall be returned unserved. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates hereof, and make due return as the law directs.
