CITATION BY PUBLICATION STATE OF TEXAS TO: MARJORIE HAYES TAYLOR, ISAAC HAYES, JR., JAMES AUTHUR HAYES, WILLIE DEAN HAYES BROWN, AND THEIR UNKNOWN HEIRS, SUCCESSORS, OR ASSIGNS, Defendants - GREETINGS: You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two (42) days from the date of the issuance of this citation, a default judgment may be taken against you. You are hereby commanded to appear by filing a written answer to the Plaintiff’s Application for Appointment of Receiver at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being Monday, MAY 10, 2021, before the Honorable Brad Morin, 71st Judicial District Court of Harrison County, Texas, at the Court House of said County in Marshall, Texas. ROCKCLIFF ENERGY OPERATING LLC, Petitioner, filed suit in said Court on the 22nd day of March, 2021, against MARJORIE HAYES TAYLOR, ISAAC HAYES, JR., JAMES AUTHUR HAYES, WILLIE DEAN HAYES BROWN, and their Unknown Heirs Successors or Assigns, Defendant, and said suit being numbered 21-0269 on the docket of said Court, and styled, ROCKCLIFF ENERGY OPERATING LLC vs. MARJORIE HAYES TAYLOR, ISAAC HAYES, JR., JAMES AUTHUR HAYES, WILLIE DEAN HAYES BROWN, AND THEIR UNKNOWN HEIRS, SUCCESSORS, OR ASSIGNS, Defendants. A brief statement of the nature of this suit is as follows, to wit: Plaintiff is seeking Appointment of a Receiver to execute oil, gas and mineral lease, assignment, memorandum of oil and gas lease or other necessary documents relating to the undivided mineral and leasehold interest for the following tracts of land: FIRST TRACT: 16.229 acres of land, more or less, out of the Henry Harper Survey, A-11, Harrison County, Texas, and being more fully described as “Tract B” in that certain Partition Deed dated May 26, 1978, by and between Harrison Holloway, Jr., Marion Holloway, Ruthie Mae Holloway Dennis, Tom Anderson, J.B. Rudd, W.L. Rudd, Jr. and Margaret Rudd Youngblood, recorded in Volume 852, Page 136, Deed Records of Harrison County, Texas. SECOND TRACT: 32.458 acres, also called 32.45 acres, more or less out of the Henry Harper Survey, A-11, Harrison County, Texas, being the same land described as “Tract C” in that certain Partition Deed dated May 26, 1978, by and between Harrison Holloway, Jr., Marion Holloway, Ruthie Mae Holloway Dennis, Tom Anderson, J.B. Rudd, W.L. Rudd, Jr. and Margaret Rudd Youngblood, recorded in Volume 852, Page 136, Deed Records of Harrison County, Texas. Petitioner is represented by RICKEY L. FAULKNER, P.O. BOX 2665, LONGVIEW, TEXAS, 75606. If this Citation is not served within ninety days after the date of its issuance, it shall be returned unserved. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates hereof, and make due return as the law directs.
