CITATION BY PUBLICATION STATE OF TEXAS TO: Delia Hansell, Deceased and her Unknown Heirs, Successors or Assigns, Defendant - GREETINGS: You have been sued. You may employ an attorney. If you or your attorney does not file a written answer with the clerk who issued this citation by 10:00 a.m. on the Monday next following the expiration of forty-two (42) days from the date of the issuance of this citation, a default judgment may be taken against you. You are hereby commanded to appear by filing a written answer to the Plaintiff’s Application for Appointment of Receiver at or before ten o’clock a.m. of the Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being Monday August 24, 2020, before the Honorable Brad Morin, 71st Judicial District Court of Harrison County, Texas, at the Court House of said County in Marshall, Texas. ROCKCLIFF ENERGY OPERATING LLC, Petitioner, filed suit in said Court on the 7th day of July, 2020, against Charlotte M. Garner, Deceased, and her Unknown Heirs Successors or Assigns, Defendant, and said suit being numbered 20-0642 on the docket of said Court, and styled, ROCKCLIFF ENERGY OPERATING LLC vs. DELIA HANSELL and HER UNKNOWN HEIRS, SUCCESSORS OR ASSIGNS. A brief statement of the nature of this suit is as follows, to wit: Plaintiff is seeking Appointment of a Receiver to execute oil, gas and mineral lease, assignment, memorandum of oil and gas lease or other necessary documents relating to the undivided mineral and leasehold interest for the following tracts of land: FIRST TRACT: Being 24.0 acres of land, more or less, situated in the H. Harper Survey, A-11, Harrison County, Texas, and being the same land described as “Block 11” set aside to Dan Hansell in that certain Report of Commissioners and Decree of Partition dated February 3, 1928, a certified copy of which is recorded in Volume 384, Page 568 of the Deed Records of Harrison County, Texas, in Lottie Richardson, et. al., vs. Alfred Hansell, et. al. SECOND TRACT: Being 45.0 acres of land, more or less, situated in the H. Harper Survey, A-11, Harrison County, Texas, and being 50 acres of land described in that certain Deed dated December 22, 1914 from Dan Hansell to Dan Hansell, Jr., and recorded in Volume 86, Page 193 of the Deed Records of Harrison County, Texas; LESS AND EXCEPT: 2.50 acres, more or less, being the same land described in that certain Correction Deed dated February 5, 1953, recorded in Volume 413, Page 97 of the Deed Records of Harrison County, Texas, from Dan Hansell, Jr., and wife, Amelia Hansell, as Grantors, to Louverta Jones Sneed, as Grantee; and further LESS AND EXCEPT 2.50 acres, more or less, being the same land described in that certain Warranty Deed dated December 17, 1926, and recorded in Volume 143, Page 526 of the Deed Records of Harrison County, Texas, from Dan Hansell, Jr., and wife, Amelia Hansell, as Grantors, to Will Jones, as Grantee; LEAVING HEREIN: 45.0 acres, more or less. THIRD TRACT: Being 2.5 acres, more or less, situated in the H. Harper Survey, A-11, Harrison County, Texas, and being the same land described in that certain Warranty Deed dated December 17, 1926, and recorded in Volume 143, Page 526 of the Deed Records of Harrison County, Texas, from Dan Hansell, Jr., and wife, Amelia Hansell, as Grantors, to Will Jones, as Grantee. INSOFAR AND ONLY INSOFAR AS TO THOSE DEPTHS WHICH ARE DEEPER THAN 100 FEET BELOW THE STRATIGRAPHIC EQUIVALENT OF THE BASE OF THE COTTON VALLEY FORMATION; ALL SHALLOWER DEPTHS ARE SPECIFICALLY EXCLUDED. Petitioner is represented by RICKEY L. FAULKNER, P.O. BOX 2665, LONGVIEW, TEXAS, 75606. If this Citation is not served within ninety days after the date of its issuance, it shall be returned unserved. The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates hereof, and make due return as the law directs.
