NOTICE OF SALE STATE OF TEXAS X BY VIRTUE OF AN ORDER OF SALE X X PANOLA COUNTY X DATED April 9, 2018 and issued pursuant to judgment decree of the County Court at Law of Panola County, Texas, by the Clerk of said Court on said date, in the hereinafter number and styled suit and to me directed and delivered as Sheriff of said County, I have on May 9, 2018, seized, levied upon, and will, on the first Tuesday in July, 2018, the same being the 3rd day of each said month, at the East Door of the Courthouse of said County, in the City of Carthage, Texas, between the hours of 10:00 o’clock a.m. and 4:00 o’clock p.m. on said day, beginning at 1:00 p.m., proceed to sell for cash to the highest bidder all the right, title, interest of the Defendant in such suit in and to the following described real estate and manufactured home levied upon as the property of said Defendant, the same lying and being situated in the County of Panola and the State of Texas, to-wit: SUIT NO. STYLE OF SUIT AND PROPERTY DESCRIPTION Cause No. 2017-219 John K. Cain, Trustee of the J.K. & J.B. Cain Living Trust, Dated June 24, 1994, Plaintiff, vs. James Eric Martin, Defendant, County Court at Law, Panola County, Texas. All that certain two (2) acres of land, more or less, a part of the Moses Shook Survey, Abstract No. 625, situated in Panola County, Texas and described as follows: Lying East of Sabine River on Shreveport Highway from Carthage, and being a part of the tract conveyed by Gordon David to Frank Jernigan and lying North and West of said highway and South or East of old public road, center line of old road being the land line of this original tract and also this 2 acres; and BEGINNING at a point 50 feet from center of highway and at the East comer of a tract Lovell Kelley bought from Frank Jernigan; THENCE North 12 deg. 30 min. East 303.6 feet parallel to and 50 feet distance from center line of the highway; THENCE North 79 deg. 30 min. West 396.2 feet parallel to the East line of Lovell Kelley tract to a stake in the center of old road; THENCE with center of old road South 15 East 340 feet to the Northwest comer Lovell Kelley tract; THENCE South 79 deg. 30 min. East 207 feet with the line of Lovell Kelley tract to the place of beginning, and containing two (2) tracts of land; SAVE AND EXCEPT the East one acre of the above described tract this day conveyed by Grantor to Jimmie Luther McGuire. And being the same 2.0 acre tract, identified in Warranty Deed from Scarborough to James and Catherine Martin, dated October 7,2015, recorded in Volume 1844, Page 657, Official Public Records of Panola County, Texas, and a Fleetwood manufactured home, 16 x 76, label number PFS0825321, serial number TXFL312A42737V012 (any volume and page reference, unless otherwise indicated, being to the Deed Records, Panola County, Texas, to which instruments reference may be made for a more complete description of each respective tract.) or, upon the written request of said defendant or his attorney, a sufficient portion of the property described above shall be sold to satisfy said judgment, interest, penalties, and cost. Said sale to be made by me to satisfy the judgment rendered in the above styled and numbered cause, together with interest, penalties, and costs of suit, and the proceeds of said sales to be applied to the satisfaction thereof, and the remainder, if any, to be applied as the law directs.
